Terms of Service

Effective Date: December 11, 2025

These Terms of Service ("Terms") govern your use of the VA Records Authorization Portal operated by Homefront Group, LLC ("Homefront Group," "we," "us," or "our") at va.hfgcarl.com (the "Service"). By using this Service, you agree to these Terms.

1. Description of Service

The VA Records Authorization Portal allows veterans to authorize Homefront Group to access their VA records through the VA.gov OAuth system. This authorization enables our legal team to:

• Review your VA claims history and appealable issues
• Identify potential rating increases or appeal opportunities
• Build documentation to support your disability claims

This Service is provided as part of our legal representation services for veterans seeking assistance with VA disability claims and appeals.

2. Eligibility

To use this Service, you must:

• Be a United States veteran with a VA.gov account
• Be 18 years of age or older
• Be seeking legal representation for VA disability claims or appeals
• Have the legal capacity to authorize access to your VA records

3. Authorization Process

When you use this Service:

• You will be redirected to VA.gov to authenticate using Login.gov or ID.me
• VA.gov will display exactly what data you are authorizing us to access
• You must explicitly approve the authorization request on VA.gov
• Upon approval, we will retrieve the authorized data to assist with your legal case

4. Scope of Authorization

By authorizing access through this Service, you grant Homefront Group permission to:

• Access your VA appealable issues data
• View your VA profile information (name and veteran ID)
• Store this information in our secure database for use in your legal case

We will only access data within the scope you authorize on VA.gov. We will not access additional VA APIs or data without obtaining separate authorization.

5. Revoking Authorization

You may revoke our access to your VA records at any time by:

• Visiting VA.gov Connected Apps
• Locating Homefront Group in your connected apps list
• Clicking "Disconnect" to revoke access

Revoking access immediately invalidates our authorization tokens. However, data already retrieved and stored may be retained as part of your legal case file, subject to our data retention policies.

6. Legal Representation

Use of this Service is intended to facilitate legal representation. Important notes:

• This Service does not by itself create an attorney-client relationship
• Legal representation is governed by a separate engagement agreement
• Our fees are governed by 38 CFR 14.636 and disclosed in our engagement agreement
• Homefront Group is accredited by the VA to represent veterans under 38 CFR 14.629

7. Your Responsibilities

When using this Service, you agree to:

• Provide accurate information about your identity
• Only authorize access to your own VA records (not someone else's)
• Notify us if you believe your authorization has been compromised
• Keep your VA.gov login credentials secure

8. Privacy

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this Service, you consent to our data practices as described in the Privacy Policy.

9. Security

We implement industry-standard security measures to protect your data, including:

• TLS encryption for all data in transit
• AES-256 encryption for data at rest
• HIPAA-compliant audit logging
• Regular security assessments and automated patching

While we take reasonable measures to protect your information, no system is completely secure. You acknowledge this inherent risk when using internet-based services.

10. Service Availability

We strive to maintain consistent availability of the Service, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• VA.gov system outages or maintenance
• Technical issues beyond our control
• Security incidents requiring service suspension

We are not liable for any damages resulting from service unavailability.

11. Limitation of Liability

To the maximum extent permitted by law:

• This Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability for any claims related to this Service shall not exceed the fees you have paid to Homefront Group

These limitations do not apply to the extent prohibited by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Homefront Group, its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the Service
• Your provision of false or misleading information

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms with a new effective date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• At our discretion, with or without cause

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the State of Arizona without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Maricopa County, Arizona.

16. Dispute Resolution

Before filing any legal claim, you agree to first contact us to attempt informal resolution. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal legal action.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any legal engagement agreement, constitute the entire agreement between you and Homefront Group regarding use of this Service.

19. Contact Information

By using the VA Records Authorization Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
